Terms of Service

Note: These Terms of Service have been drafted to comprehensively cover the features and functionality of the WalkTalk application. We recommend consulting with a qualified attorney for jurisdiction-specific compliance review before relying on this document for legal purposes.
Welcome to WalkTalk! These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and WalkTalk ("we," "our," or "us"), an individual developer based in the European Union, governing your use of the WalkTalk mobile application ("App"), available at the App Store.
By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
1. Eligibility
Age Requirement: You must be at least 18 years of age to use WalkTalk.
By using the App, you represent and warrant that:
- You are at least 18 years old
- You have the legal capacity to enter into a binding agreement
- You are not prohibited from using the App under the laws of your jurisdiction
- You have not been previously banned or removed from WalkTalk
If we discover or have reason to believe that you do not meet these eligibility requirements, we may suspend or terminate your account immediately.
2. Account Registration and Security
2.1 Account Creation
To access the full features of WalkTalk, you must create an account using Firebase Authentication (email/password or Google Sign-In). You agree to:
- Provide accurate, current, and complete registration information
- Maintain and promptly update your information to keep it accurate
- Keep your password and account credentials secure and confidential
- Accept full responsibility for all activities that occur under your account
- Notify us immediately at technical_support@walktalk.me of any unauthorized use of your account
2.2 Single-Device Policy
WalkTalk enforces a single-device login policy. Only one device may be actively logged into your account at any time. Logging in on a new device will automatically invalidate sessions on all other devices. This is a security measure to protect your account and the privacy of your location data.
2.3 Account Suspension and Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms, suspected fraud, abusive behavior, or any other reason we deem appropriate. We may also terminate inactive accounts after extended periods of non-use.
3. Description of Service
WalkTalk is a social networking application that facilitates in-person walking activities. Key features include:
- Activity discovery and creation: Find nearby walking activities or create your own, including tea time, baby walks, and dog walking sessions
- Real-time location sharing: See other participants on a live map during active walking sessions
- Turn-by-turn walking navigation: Navigate to meeting points and checkpoints with voice guidance
- AR navigation: Augmented reality overlay for walking directions
- In-app messaging: Chat with activity participants before, during, and after walks
- Gamification: Earn XP, badges, and compete on leaderboards through walking activities, streaks, and challenges
- Route checkpoints: Follow curated walking routes with points of interest
- Live Activity widgets: iOS Lock Screen widgets showing walk progress and navigation
We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice.
4. User Conduct
You agree to use WalkTalk in a lawful and respectful manner. You agree NOT to:
- Harass, abuse, threaten, stalk, or intimidate other users
- Post or transmit content that is offensive, defamatory, obscene, pornographic, violent, discriminatory, or otherwise objectionable
- Impersonate any person, entity, or falsely represent your affiliation with any person or entity
- Create false, misleading, or fraudulent activity listings
- Use the App for any commercial purpose without our prior written authorization
- Collect, harvest, or scrape other users' personal information, including location data
- Use the location features to track, follow, or surveil other users outside of agreed-upon activities
- Interfere with, disrupt, or attempt to gain unauthorized access to the App, its servers, or related systems
- Use automated means (bots, scripts, scrapers) to access or interact with the App, except as provided by us
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
- Circumvent, disable, or interfere with any security, rate-limiting, or access-restriction features
- Share your account credentials with others or operate multiple accounts
- Use the App to facilitate illegal activities, including but not limited to drug use, underage drinking, or criminal behavior
- Exploit bugs, glitches, or vulnerabilities in the App rather than reporting them
- Upload malware, viruses, or other harmful code
Violation of these conduct rules may result in content removal, account suspension, permanent ban, and/or legal action.
5. Activities and Safety
Physical Activity Risk: Walking activities involve physical exertion and exposure to outdoor conditions. By participating in activities through WalkTalk, you acknowledge that physical activity carries inherent risks, including but not limited to injury, illness, and adverse weather conditions. You should consult with a medical professional before engaging in any new exercise program.
5.1 User Interactions
WalkTalk facilitates connections between users for walking activities. You understand and agree that:
- We do not conduct background checks, identity verification, or criminal history screening on users
- You assume all risks associated with meeting and interacting with other users in person
- You should always meet in well-lit, public places and inform someone you trust of your plans
- We are not responsible for the conduct, actions, or omissions of any user
- You should exercise your own judgment and take reasonable safety precautions
5.2 Navigation and Route Accuracy
Navigation Disclaimer: Walking directions, checkpoint routes, AR navigation overlays, and distance/ETA estimates provided through WalkTalk are for informational purposes only. Routes are generated using third-party services (Mapbox, Google Places) and may contain errors, be outdated, or not account for current conditions (construction, closures, hazards). Always use your own judgment, obey local traffic laws, and be aware of your surroundings. Do not rely solely on the App for navigation, especially in unfamiliar areas or conditions with poor GPS signal.
5.3 Weather Information
Weather data displayed in the App is sourced from third-party providers (Apple WeatherKit, OpenWeatherMap) and is provided for convenience only. We do not guarantee the accuracy of weather information. Always check official weather forecasts before planning outdoor activities, especially in severe weather conditions.
5.4 Your Responsibility
You are solely responsible for your own safety and well-being during activities. If you feel unsafe at any time, leave the activity immediately. WalkTalk is not a substitute for emergency services. In case of emergency, call your local emergency number.
6. AI-Powered Features and Bot Disclosure
Bot Disclosure: WalkTalk includes AI-powered bot users that may create activities and engage in conversations. These include "Ghost Host" bots and "Agent" bots designed to enhance the community experience. Bot interactions are powered by Google Gemini AI.
6.1 AI-Powered Bots
- Bot users may create activities, send chat messages, and participate in the community
- Bot conversations follow a structured flow and may transition from active engagement to disengagement
- Bot users have profiles, personality traits, and interaction styles but are not real people
- We make reasonable efforts to ensure bot behavior is appropriate and consistent with community standards
6.2 AI-Generated Content
- Suggested replies: The App may suggest reply options for messages. These are generated by on-device AI (iOS 26+) or server-side AI and are offered as suggestions only
- Smart Compose: Premium users on iOS 26+ may see AI-generated text predictions while typing, processed entirely on-device
- Activity summaries: AI may generate summaries and achievement descriptions after activities complete
6.3 Content Moderation
User-generated content (messages, images, activity descriptions) is subject to automated moderation:
- Text is checked against keyword filters and the OpenAI Moderation API for toxicity
- Images are analyzed by Google Cloud Vision SafeSearch for harmful content
- Content that violates our guidelines may be blocked, hidden, or removed without prior notice
- If you believe your content was incorrectly moderated, contact us at technical_support@walktalk.me to request a human review
6.4 No Guarantee of AI Accuracy
AI-generated content (suggested replies, summaries, bot conversations) may contain inaccuracies, errors, or inappropriate content despite our best efforts. We do not guarantee the accuracy, completeness, or appropriateness of any AI-generated content. You should not rely on AI-generated content for any important decisions.
7. Subscription Plans
7.1 Subscription Tiers
WalkTalk requires a paid subscription. After account creation, you must subscribe to either the Basic or Premium tier to use the App.

We reserve the right to modify subscription features, limits, and pricing at any time. Changes to existing subscriptions will take effect at the next billing period.
7.2 Subscription Products
The following subscription products are available:
- Basic Monthly
- Basic Yearly
- Premium Monthly
- Premium Yearly
- Premium Lifetime (one-time purchase)
8. Payments and Billing
8.1 Apple In-App Purchases
For most users, subscriptions are billed through your Apple ID account via Apple's In-App Purchase system (StoreKit 2):
- Billing: Charges are processed by Apple through your App Store account
- Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- Renewal charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price
- Free trials: If offered, free trials convert to paid subscriptions unless cancelled before the trial period ends. Unused portions of free trials are forfeited upon purchasing a subscription
- Price changes: Price changes will be communicated in advance and take effect at the next billing period. Where required by Apple, you will be asked to agree to the new price
- Managing subscriptions: You can manage and cancel subscriptions in your Apple ID account settings (Settings > Apple ID > Subscriptions)
- Refunds: Refund requests for Apple In-App Purchases are handled by Apple according to their refund policy. WalkTalk does not process refunds for App Store purchases directly
8.2 Lifetime Purchases
Lifetime Premium purchases are one-time payments granting permanent access to Premium features for the lifetime of the App. "Lifetime" means for as long as WalkTalk continues to operate. In the event that WalkTalk ceases operations, we will provide reasonable notice.
8.3 General Billing Terms
- Cancellation takes effect at the end of the current billing period. You will retain access to your subscription tier until the period expires
- No refunds are provided for partial subscription periods unless required by applicable law
- Downgrading from Premium to Basic takes effect at the end of the current billing period
- If your payment fails, you may enter a grace period or billing retry state where your subscription features are temporarily maintained while the payment issue is resolved
9. User Content and License
9.1 Your Content
You retain ownership of content you create and post through the App, including profile photos, chat messages, activity descriptions, and images ("User Content"). By posting User Content, you grant WalkTalk a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, display, distribute, and create derivative works from your User Content in connection with operating, providing, promoting, and improving the App.
This license includes the right to:
- Display your profile information to other users
- Transmit your messages to intended recipients
- Store, cache, and process your content for App functionality
- Analyze your content for moderation and safety purposes
- Use AI to process your messages for features like suggested replies and summaries
- Remove, modify, or restrict access to content that violates these Terms
This license continues until you delete the specific content or your account, except where your content has been shared with or by other users and they have not deleted it.
9.2 Content Representations
You represent and warrant that:
- You own or have the necessary rights to post your User Content
- Your User Content does not infringe any third party's intellectual property, privacy, publicity, or other rights
- Your User Content complies with these Terms and all applicable laws
9.3 Content Removal
We reserve the right to remove or disable access to any User Content at any time, with or without notice, for any reason, including content that we believe violates these Terms or is harmful to users or the App.
10. Intellectual Property
10.1 WalkTalk's Intellectual Property
The App, including but not limited to its software, design, user interface, graphics, logos, icons, animations (including Rive animations), sounds, text, features, algorithms, and overall structure, is the property of WalkTalk and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
10.2 Restrictions
You may not, without our prior written permission:
- Copy, modify, distribute, sell, lease, or create derivative works based on the App
- Reverse engineer, decompile, or disassemble the App
- Use the WalkTalk name, logo, or branding for any purpose
- Remove, obscure, or alter any proprietary notices or labels in the App
- Use the App's content or features to build a competing product or service
10.3 Feedback
If you provide us with suggestions, ideas, or feedback about the App ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, modify, and implement that Feedback without any obligation to you.
10.4 Third-Party Content
The App includes third-party content and services (maps from Mapbox, weather from Apple/OpenWeatherMap, POI data from Google Places/Wikipedia). This content is subject to the respective third parties' terms and licenses. We make no warranties regarding third-party content.
11. Privacy
Your privacy is important to us. Our Privacy Policy describes how we collect, use, store, share, and protect your personal information. The Privacy Policy is incorporated into these Terms by reference. By using the App, you agree to the collection and use of information as described in the Privacy Policy.
12. Disclaimers
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT
- WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
- WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT, INCLUDING WALKING DIRECTIONS, NAVIGATION ROUTES, AR OVERLAYS, CHECKPOINT ROUTES, DISTANCE CALCULATIONS, ETA ESTIMATES, ELEVATION DATA, OR WEATHER INFORMATION
- WE DO NOT WARRANT THAT THE APP WILL BE COMPATIBLE WITH YOUR DEVICE OR OPERATING SYSTEM VERSION
- WE DO NOT ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY USER, ACTIVITY, ROUTE, OR LOCATION
- WE ARE NOT RESPONSIBLE FOR THE AVAILABILITY, ACCURACY, OR RELIABILITY OF THIRD-PARTY SERVICES (MAPBOX, FIREBASE, APPLE WEATHERKIT, OPENWEATHERMAP, GOOGLE PLACES, STRIPE, WIKIPEDIA)
- AI-GENERATED CONTENT (BOT CONVERSATIONS, SUGGESTED REPLIES, ACTIVITY SUMMARIES) IS PROVIDED WITHOUT WARRANTY OF ACCURACY OR APPROPRIATENESS
- GAMIFICATION FEATURES (LEADERBOARDS, BADGES, STREAKS, CHALLENGES) ARE FOR ENTERTAINMENT PURPOSES AND WE RESERVE THE RIGHT TO MODIFY, RESET, OR REMOVE THEM
Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the above exclusions apply to the fullest extent permitted by law. Nothing in these Terms affects your statutory rights as a consumer under the laws of the European Union or your country of residence.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- No consequential damages: WALKTALK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF THE THEORY OF LIABILITY
- No liability for user interactions: WALKTALK SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR INTERACTIONS WITH OTHER USERS, INCLUDING BUT NOT LIMITED TO PHYSICAL INJURY, PROPERTY DAMAGE, EMOTIONAL DISTRESS, OR FINANCIAL LOSS
- No liability for navigation: WALKTALK SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR RELIANCE ON WALKING DIRECTIONS, NAVIGATION ROUTES, AR OVERLAYS, DISTANCE ESTIMATES, OR OTHER LOCATION-BASED INFORMATION PROVIDED THROUGH THE APP
- Aggregate cap: IN NO EVENT SHALL WALKTALK'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO WALKTALK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED EUROS (€100)
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
14. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless WalkTalk, and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:
- Your use of or access to the App
- Your violation of these Terms
- Your violation of any third party's rights, including intellectual property, privacy, or publicity rights
- Your User Content
- Your interactions with other users, including in-person meetings
- Your violation of any applicable law, regulation, or rule
This indemnification obligation will survive the termination of these Terms and your use of the App. This section does not apply to the extent prohibited by applicable law, including EU consumer protection regulations.
15. Dispute Resolution
15.1 Informal Resolution
Before initiating any formal dispute resolution proceedings, you agree to first attempt to resolve the dispute informally by contacting us at technical_support@walktalk.me. We will attempt to resolve the dispute within 30 days of receiving your written notice. Your notice must include your name, account details, a description of the dispute, and the resolution you seek.
15.2 Binding Arbitration
If the dispute is not resolved informally within 30 days, either party may submit the dispute to binding arbitration. The arbitration shall be:
- Conducted by a single arbitrator
- Held in the European Union, or at the claimant's election, via telephone, video conference, or written submissions
- Conducted in English
- Governed by the rules of the European Court of Arbitration or another mutually agreed arbitration body
The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
15.3 Class Action Waiver
Class Action Waiver: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND WALKTALK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and WalkTalk agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
This waiver does not apply where prohibited by applicable law, including EU consumer protection regulations that guarantee collective redress rights.
15.4 Exceptions
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights. Additionally, small claims court actions may be filed in a court of competent jurisdiction.
15.5 EU Consumer Rights
If you are a consumer in the European Union, nothing in this dispute resolution section restricts your right to bring proceedings in the courts of the EU Member State in which you are domiciled, as provided under Regulation (EU) No 1215/2012. You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
16. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the European Union and the laws of the EU Member State where the operator is established, without regard to conflict-of-law provisions.
For users outside the EU, these Terms are governed by the laws applicable in the operator's jurisdiction.
Nothing in these Terms shall deprive you of any mandatory consumer protection rights afforded to you under the laws of your country of residence.
17. Termination
17.1 Termination by You
You may terminate your account at any time by deleting it through the App's Settings. Active subscriptions should be cancelled separately through the App Store to prevent further charges.
17.2 Termination by Us
We may suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination include but are not limited to:
- Violation of these Terms
- Abusive, harassing, or threatening behavior toward other users
- Repeated content moderation violations
- Suspected fraud or misuse
- Extended period of inactivity
- Request by law enforcement or government agency
17.3 Effect of Termination
Upon termination:
- Your right to access and use the App ceases immediately
- We may delete your account data in accordance with our Privacy Policy
- Any outstanding subscription charges remain your responsibility
- Sections that by their nature should survive termination will remain in effect, including but not limited to: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law
18. Force Majeure
WalkTalk shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of God, war, terrorism, riots, civil unrest, government action, labor disputes, epidemics or pandemics, power failures, internet or telecommunications failures, cyberattacks, fire, flood, or the failure of third-party services (including Firebase, Mapbox, Apple, or other service providers).
19. General Provisions
19.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and WalkTalk regarding your use of the App and supersede all prior agreements, understandings, and negotiations, whether written or oral.
19.2 Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
19.3 Waiver
The failure of WalkTalk to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any right or provision will only be effective if in writing and signed by WalkTalk.
19.4 Assignment
You may not assign or transfer these Terms or your rights or obligations hereunder without our prior written consent. WalkTalk may assign these Terms without restriction. Any attempted assignment in violation of this section is void.
19.5 Notices
We may send you notices via the App (push notifications or in-app messages) or to the email address associated with your account. You are responsible for keeping your contact information current. Notices to us must be sent to technical_support@walktalk.me.
19.6 No Third-Party Beneficiaries
These Terms are for the benefit of you and WalkTalk only. No third party shall have any right to enforce any provision of these Terms, except as expressly provided herein.
19.7 Headings
The section headings in these Terms are for convenience only and have no legal or contractual effect.
19.8 Language
These Terms are drafted in English. If these Terms are translated into any other language and there is a conflict between the English version and the translated version, the English version shall prevail.
20. Changes to Terms
We may modify these Terms at any time. When we make material changes:
- We will update the "Last Updated" date at the top of this page
- We will provide notice through the App via push notification or in-app message
- For material changes that may adversely affect your rights, we will provide at least 30 days' advance notice where required by applicable law
- If you disagree with the revised Terms, you must stop using the App and delete your account before the changes take effect
Your continued use of WalkTalk after the effective date of any changes constitutes your acceptance of the updated Terms.
