Welcome to WalkTalk! These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and WalkTalk ("we," "our," or "us"), an individual developer based in the European Union, governing your use of the WalkTalk mobile application ("App"), available at the App Store.

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

1. Eligibility

2. Account Registration and Security

To access the full features of WalkTalk, you must create an account using Firebase Authentication (email/password or Google Sign-In). You agree to:

WalkTalk enforces a single-device login policy. Only one device may be actively logged into your account at any time. Logging in on a new device will automatically invalidate sessions on all other devices. This is a security measure to protect your account and the privacy of your location data.

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms, suspected fraud, abusive behavior, or any other reason we deem appropriate. We may also terminate inactive accounts after extended periods of non-use.

5. Activities and Safety

Physical Activity Risk: Walking activities involve physical exertion and exposure to outdoor conditions. By participating in activities through WalkTalk, you acknowledge that physical activity carries inherent risks, including but not limited to injury, illness, and adverse weather conditions. You should consult with a medical professional before engaging in any new exercise program.

Navigation Disclaimer: Walking directions, checkpoint routes, AR navigation overlays, and distance/ETA estimates provided through WalkTalk are for informational purposes only. Routes are generated using third-party services (Mapbox, Google Places) and may contain errors, be outdated, or not account for current conditions (construction, closures, hazards). Always use your own judgment, obey local traffic laws, and be aware of your surroundings. Do not rely solely on the App for navigation, especially in unfamiliar areas or conditions with poor GPS signal.

5.3 Weather Information

Weather data displayed in the App is sourced from third-party providers (Apple WeatherKit, OpenWeatherMap) and is provided for convenience only. We do not guarantee the accuracy of weather information. Always check official weather forecasts before planning outdoor activities, especially in severe weather conditions.

5.4 Your Responsibility

You are solely responsible for your own safety and well-being during activities. If you feel unsafe at any time, leave the activity immediately. WalkTalk is not a substitute for emergency services. In case of emergency, call your local emergency number.

6. AI-Powered Features and Bot Disclosure

Bot Disclosure: WalkTalk includes AI-powered bot users that may create activities and engage in conversations. These include "Ghost Host" bots and "Agent" bots designed to enhance the community experience. Bot interactions are powered by Google Gemini AI.

AI-generated content (suggested replies, summaries, bot conversations) may contain inaccuracies, errors, or inappropriate content despite our best efforts. We do not guarantee the accuracy, completeness, or appropriateness of any AI-generated content. You should not rely on AI-generated content for any important decisions.

7. Subscription Plans

7.1 Subscription Tiers

WalkTalk requires a paid subscription. After account creation, you must subscribe to either the Basic or Premium tier to use the App.

We reserve the right to modify subscription features, limits, and pricing at any time. Changes to existing subscriptions will take effect at the next billing period.

8. Payments and Billing

8.1 Apple In-App Purchases

For most users, subscriptions are billed through your Apple ID account via Apple's In-App Purchase system (StoreKit 2):

8.2 Lifetime Purchases

Lifetime Premium purchases are one-time payments granting permanent access to Premium features for the lifetime of the App. "Lifetime" means for as long as WalkTalk continues to operate. In the event that WalkTalk ceases operations, we will provide reasonable notice.

9. User Content and License

9.1 Your Content

You retain ownership of content you create and post through the App, including profile photos, chat messages, activity descriptions, and images ("User Content"). By posting User Content, you grant WalkTalk a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, display, distribute, and create derivative works from your User Content in connection with operating, providing, promoting, and improving the App.

10. Intellectual Property

10.1 WalkTalk's Intellectual Property

The App, including but not limited to its software, design, user interface, graphics, logos, icons, animations (including Rive animations), sounds, text, features, algorithms, and overall structure, is the property of WalkTalk and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

10.2 Restrictions

You may not, without our prior written permission:

If you provide us with suggestions, ideas, or feedback about the App ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, modify, and implement that Feedback without any obligation to you.

10.4 Third-Party Content

The App includes third-party content and services (maps from Mapbox, weather from Apple/OpenWeatherMap, POI data from Google Places/Wikipedia). This content is subject to the respective third parties' terms and licenses. We make no warranties regarding third-party content.

11. Privacy

Your privacy is important to us. Our Privacy Policy describes how we collect, use, store, share, and protect your personal information. The Privacy Policy is incorporated into these Terms by reference. By using the App, you agree to the collection and use of information as described in the Privacy Policy.

12. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the above exclusions apply to the fullest extent permitted by law. Nothing in these Terms affects your statutory rights as a consumer under the laws of the European Union or your country of residence.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  1. No consequential damages: WALKTALK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF THE THEORY OF LIABILITY
  2. No liability for user interactions: WALKTALK SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR INTERACTIONS WITH OTHER USERS, INCLUDING BUT NOT LIMITED TO PHYSICAL INJURY, PROPERTY DAMAGE, EMOTIONAL DISTRESS, OR FINANCIAL LOSS
  3. No liability for navigation: WALKTALK SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR RELIANCE ON WALKING DIRECTIONS, NAVIGATION ROUTES, AR OVERLAYS, DISTANCE ESTIMATES, OR OTHER LOCATION-BASED INFORMATION PROVIDED THROUGH THE APP
  4. Aggregate cap: IN NO EVENT SHALL WALKTALK'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO WALKTALK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED EUROS (€100)

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

14. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless WalkTalk, and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

This indemnification obligation will survive the termination of these Terms and your use of the App. This section does not apply to the extent prohibited by applicable law, including EU consumer protection regulations.

15. Dispute Resolution

15.1 Informal Resolution

Before initiating any formal dispute resolution proceedings, you agree to first attempt to resolve the dispute informally by contacting us at technical_support@walktalk.me. We will attempt to resolve the dispute within 30 days of receiving your written notice. Your notice must include your name, account details, a description of the dispute, and the resolution you seek.

15.2 Binding Arbitration

If the dispute is not resolved informally within 30 days, either party may submit the dispute to binding arbitration. The arbitration shall be:

The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

15.3 Class Action Waiver

Class Action Waiver: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND WALKTALK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and WalkTalk agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

This waiver does not apply where prohibited by applicable law, including EU consumer protection regulations that guarantee collective redress rights.

15.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights. Additionally, small claims court actions may be filed in a court of competent jurisdiction.

15.5 EU Consumer Rights

If you are a consumer in the European Union, nothing in this dispute resolution section restricts your right to bring proceedings in the courts of the EU Member State in which you are domiciled, as provided under Regulation (EU) No 1215/2012. You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the European Union and the laws of the EU Member State where the operator is established, without regard to conflict-of-law provisions.

For users outside the EU, these Terms are governed by the laws applicable in the operator's jurisdiction.

Nothing in these Terms shall deprive you of any mandatory consumer protection rights afforded to you under the laws of your country of residence.

17. Termination

17.1 Termination by You

You may terminate your account at any time by deleting it through the App's Settings. Active subscriptions should be cancelled separately through the App Store to prevent further charges.

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination include but are not limited to:

WalkTalk shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of God, war, terrorism, riots, civil unrest, government action, labor disputes, epidemics or pandemics, power failures, internet or telecommunications failures, cyberattacks, fire, flood, or the failure of third-party services (including Firebase, Mapbox, Apple, or other service providers).

19. General Provisions

19.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and WalkTalk regarding your use of the App and supersede all prior agreements, understandings, and negotiations, whether written or oral.

19.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

19.3 Waiver

The failure of WalkTalk to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any right or provision will only be effective if in writing and signed by WalkTalk.

19.4 Assignment

You may not assign or transfer these Terms or your rights or obligations hereunder without our prior written consent. WalkTalk may assign these Terms without restriction. Any attempted assignment in violation of this section is void.

19.5 Notices

We may send you notices via the App (push notifications or in-app messages) or to the email address associated with your account. You are responsible for keeping your contact information current. Notices to us must be sent to technical_support@walktalk.me.

19.6 No Third-Party Beneficiaries

These Terms are for the benefit of you and WalkTalk only. No third party shall have any right to enforce any provision of these Terms, except as expressly provided herein.

19.7 Headings

The section headings in these Terms are for convenience only and have no legal or contractual effect.

19.8 Language

These Terms are drafted in English. If these Terms are translated into any other language and there is a conflict between the English version and the translated version, the English version shall prevail.

20. Changes to Terms

We may modify these Terms at any time. When we make material changes:
